This website is operated by SALMA MYA. Throughout the site, the terms "we", "us" and "our" refer to SALMA MYA. SALMA MYA offers this website, including all information, tools and services available from this site to you, the user (the "Services"), conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our Services and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink, such as our Privacy Policy. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website, as they include important information about your legal rights, such as warranty disclaimers and limitations of liability. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Section 1 - Access, Accounts and Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country or territory of residence, and you have given us your consent to allow any of your minor dependants to use this site.
To use the Services, including browsing our online store or purchasing any products, you may be asked to provide certain information, such as your email address and billing, payment and shipping details. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it. You are solely responsible for maintaining the security of any account credentials and for all activity carried out under your account.
You may not use our products or the Services for any illegal or unauthorised purpose, nor may you, in your use of the Services, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses or any code of a destructive nature. A breach or violation of any of these Terms will result in immediate termination of your access to the Services.
Section 2 - Our Products
We have made every effort to display, as accurately as possible, the colours, materials and finishes of our candles and personalised designs. However, please note that colours and design appearance may differ from how they appear on your screen, due to variations in monitor calibration, screen brightness, and mobile display settings. We do not warrant that the appearance of any product purchased by you will be identical to how it appeared on your screen.
All product descriptions are subject to change at any time, at our sole discretion and without notice. We reserve the right to discontinue any product, fragrance, or design at any time, and to limit the quantities of any products we offer to any person, household, or region.
Section 3 - Contract Formation and Ordering
You can order from us through our online checkout process. Once we have received your order, we will send you an order acknowledgement via email detailing the product(s) you have ordered. It is your responsibility to check the order details and advise us immediately of any errors or omissions.
Please note that this acknowledgement does not mean your order has been accepted. Payment is taken in full at the time your order is placed. Your order constitutes an offer to us to buy the item(s) at the advertised price, and acceptance of that offer — completing the contract between you and us — takes place strictly upon dispatch of the product(s) ordered, confirmed via a "Dispatch Confirmation" email.
If we cannot accept your order, we will inform you promptly by email and issue you a full refund. This may occur if goods are unavailable, there is an unmistakable pricing error on the website, or due to customisation constraints detailed in Section 4.
You represent and warrant that your purchases are for your own personal or household use, and not for commercial resale or export, unless we have otherwise agreed with you in writing.
Section 4 - Personalised and Custom-Made Products
Because SALMA MYA specialises in bespoke design collections and personalised candle items, specific statutory rules apply to these transactions:
  • Customer Proofing Responsibility: It is your absolute responsibility to check all customisation details—including spelling, names, dates, layouts, and capitalisation—before submitting your order. You must advise us immediately of any errors or omissions by emailing hello@salmamya.co.uk. Because we begin personalised designs shortly after orders are received, we cannot cancel, amend, or refund orders that have been misspelled by you, or where you simply change your mind.
  • Content Restrictions: We reserve the right to refuse or cancel orders for personalised products that contain content that is offensive, discriminatory, threatening, obscene, in breach of confidence or privacy, or which may otherwise cause annoyance, distress, or inconvenience.
  • Exemption from Cancellation Rights: Personalised, bespoke, or custom-made items are legally exempt from standard statutory consumer cancellation and 14-day cooling-off rights under UK law. Once production has started, these items cannot be returned, cancelled, or refunded unless they are fundamentally faulty.
Section 5 - Prices and Billing
Prices, discounts and promotions for our products are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as set out in your order confirmation email. Unless expressly stated otherwise, posted prices do not include shipping, handling, customs or import charges.
We reserve the right at any time to modify or discontinue the Services (or any part or content thereof) without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Services.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update this information (including your email address and payment details) so that we can complete your transactions and contact you as needed. We reserve the right to refuse any order, and may, at our sole discretion, limit or cancel quantities purchased per person, household, or order — including orders placed under the same account, payment card, and/or billing or shipping address.
You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are duly authorised to use the chosen payment method, and (iii) charges incurred by you will be honoured by your card issuer or payment provider.
Section 6 - Handcrafted Variations, Natural Wax Disclaimer & Safety Waiver
Our candles are proudly hand-poured and crafted in Yorkshire, using premium fragrance oils and materials carefully sourced within Europe.
  • Handcrafted Variations & Natural Wax Character: Because our products are handcrafted and individually personalised, natural variations will occur. The personalisation element of our candles consists of custom designs, personalised directly by the customer. Please be explicitly aware that the colours of these designs can look different on a digital screen than they do in real life. Due to variations in monitor calibration, screen brightness, and mobile display settings, printed design colours may vary slightly from what is viewed online. Sizing, text placement, wax colour, and final design layouts may also vary slightly depending on your personalised text inputs. All measurements, descriptions, and visual representations provided are approximate. We use high-quality natural wax blends; consequently, natural cosmetic characteristics such as slight colour variation, discolouration over time, "frosting" (a white, crystalline appearance), surface sweating, minor air bubbles, or slight shrinkage away from the glass due to temperature shifts are entirely normal. These are indicators of natural wax purity and the unique chemical behaviour of specific premium fragrance oils; they do not affect the candle's performance and do not constitute a product defect or fault.
  • Candle Safety: When purchasing from SALMA MYA, you acknowledge that candles involve an open flame and inherent risks. Each product comes equipped with mandatory CLP safety warning graphics and instructions. It is your absolute responsibility to read and strictly adhere to these care guidelines (including, but not limited to: keeping wicks trimmed, burning on heat-resistant surfaces, never leaving a burning candle unattended, and keeping candles out of reach of children and pets). SALMA MYA accepts no liability for any personal injury, property damage, fire damage, or financial loss resulting from the misuse, negligent handling, or improper burning of our products.
Section 7 - Shipping and Delivery
All delivery periods stated are approximate and, whilst we will do our utmost to ensure your order reaches you within these timelines, they cannot be guaranteed. Factors outside our control (including third-party courier delays, industrial action, or peak holiday periods) may affect delivery times, and we cannot accept liability or costs incurred for failed or delayed shipments caused by third parties. Delivery will be made to the address specified in your order; if these details are incorrect, we cannot be liable for items not received. Once we transfer products to the courier, risk of loss passes to you.
If a parcel is returned to us by our courier due to an incorrect or incomplete address provided by you at checkout, or due to a failure to collect the item from a local collection depot after a missed delivery, the following terms apply:
  • Non-Personalised Items: We will automatically issue a refund for the order, minus a standard £2.95 processing fee to cover handling, administrative, and return courier costs.
  • Personalised & Custom Items: If a personalised or custom item is returned to us by the courier following a failed delivery (for example, due to an incorrect address or an uncollected parcel), it cannot be refunded, as personalised items cannot be resold to another customer. In this situation, we will hold the item and offer to resend it to you once a standard £2.95 re-delivery fee has been settled by you.
Delayed Parcels: If your order has not arrived within the estimated timeline, you must notify us within 30 days of the dispatch date for UK shipments, at hello@salmamya.co.uk. We are unable to investigate, replace, or look into delayed parcels once this period has passed.
Section 8 - Cancellations, Returns & Refunds
  • Cancellable Goods (Non-Personalised): For products that are not personalised, you have the legal right to change your mind and cancel your order within 14 days of receiving your goods. The item must be returned to us completely unused, in its original state, complete with any packaging. The cost and safe arrival of the return shipment are your responsibility, except where the item is faulty. We strongly recommend sending any returns via a tracked delivery service, as we cannot be held responsible for packages lost in transit.
  • Non-Cancellable Goods (Personalised): Products customised or custom-made to your requirements cannot be cancelled, exchanged, returned, or refunded under any circumstances, unless they arrive fundamentally damaged or faulty.
  • Damaged or Faulty Items: In the rare event that an item arrives faulty or damaged, please contact our team within 14 days of receipt at hello@salmamya.co.uk with clear photographic evidence, so that we can arrange a swift replacement or refund. In accordance with the Consumer Rights Act 2015, your statutory rights regarding goods that are inherently faulty at the time of sale are preserved under English law.
Section 9 - Payment, Promotions & Automated Subscriptions
Secure online payments are processed via Shop Pay, Apple Pay, Google Pay, and by Mastercard and Visa. We plan to introduce Klarna as an additional payment option in future. Payment card and account data is encrypted during network transfer. We assume no direct liability for the availability, external policies, or technical functionality of these third-party payment gateways, nor for any financial loss caused by their use.
Promotions and Discount Codes: Active discount codes, promotional offers, and subscription vouchers cannot be combined or used in conjunction with any other sale, offer, or promotion. Only one code may be applied per order. Each offer is limited to one use per customer and cannot be redeemed for cash or credit. Unless explicitly stated otherwise, promotional discounts apply exclusively to full-priced individual products, and exclude postage fees, shipping costs, gift cards, or special design collections.
Recurring Subscriptions: If you opt into any recurring purchase or automated subscription package, you authorise SALMA MYA to store your payment details and automatically charge your chosen payment method on a rolling schedule based on your selected frequency. Subscription cycles automatically renew. You may modify or cancel your subscription at any time through your customer portal or by contacting us, provided that cancellations are submitted at least 3 business days prior to your next scheduled billing date. Cancellations processed after billing has occurred will apply to the subsequent cycle.
Section 10 - Intellectual Property Rights
Registered Brand & Corporate Identity: SALMA MYA is a legally registered and protected brand name. We hold exclusive rights to the use of our brand name, trading identity, and corporate assets. Any unauthorised use or reproduction of the brand identity is strictly prohibited.
In-House & Licensed Intellectual Property: Unless stated otherwise, all rights, including copyright, design rights, creative concepts, website imagery, text, and brand assets, are exclusively owned by SALMA MYA, our affiliates, or our licensors, and are protected by UK and international copyright and other intellectual property laws. This library consists of:
1. Bespoke designs, illustrations, and assets created exclusively in-house by our team.
2. Commercially licensed third-party graphic assets and elements. While individual third-party components may be available for purchase or public licence by others, the unique combination, layout, typography pairing, specific styling, and collective final design composition created by SALMA MYA represents our exclusive, protected intellectual property.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material from the Services — including our website content, images, texts, or final product compositions — without our prior written consent. Any attempt to pass off our curated work as your own is strictly prohibited. Unauthorised use may amount to a violation of intellectual property law, and any violations will be pursued to the fullest extent permitted.
SALMA MYA's name, logo, product and design names, and slogans are trademarks of SALMA MYA. You must not use these without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks appearing on the Services are the property of their respective owners.
Section 11 - Optional Tools
You may be provided with access to third-party tools as part of the Services (for example, payment providers or design tools), which we neither monitor nor control.
You acknowledge and agree that we provide access to such tools "as is" and "as available", without any warranties, representations or conditions of any kind, and without endorsement. We shall have no liability arising from or relating to your use of optional third-party tools. Any use by you of such tools is entirely at your own risk and discretion, and you should ensure you are familiar with the relevant third-party provider's own terms.
We may, in the future, offer new features through the Services. Such new features shall also be deemed part of the Services and subject to these Terms.
Section 12 - Third-Party Links
The Services may contain hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you leave the Services to access these materials or sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of third-party websites, or your purchase or use of any products, services, or content on them. Please review third-party policies and practices carefully before engaging in any transaction with them. Complaints, claims, or questions regarding third-party products and services should be directed to the third party concerned.
Section 13 - Relationship with Shopify
SALMA MYA is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with SALMA MYA. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and SALMA MYA, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with SALMA MYA.
Section 14 - Privacy Policy
All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's own Privacy Policy. By using the Services, you acknowledge that you have read and understood these policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify, as well as third parties who may be located in other countries, in order to provide the Services to you. Please review our Privacy Policy for full details on how we, Shopify, and our partners use your personal information.
Section 15 - Feedback
If you submit, post, email or otherwise send us any ideas, suggestions, reviews, or other feedback ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, publish, and display such Feedback for any purpose, including commercial use — for example, displaying customer reviews on our website or in our marketing.
You represent and warrant that: (i) you own or have the necessary rights to any Feedback you provide; (ii) you have disclosed any compensation received in connection with it; and (iii) it will comply with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it. We may, but are not obliged to, remove Feedback that we consider unlawful, offensive, or otherwise objectionable.
You agree not to submit Feedback that infringes any third party's rights (including copyright, trademark, or privacy), or that contains unlawful, abusive, or obscene content, viruses, or malware. You are solely responsible for any Feedback you submit and its accuracy.
Section 16 - Errors, Inaccuracies and Omissions
Occasionally, there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change, update, or cancel orders if any information is found to be inaccurate, at any time and without prior notice (including after you have submitted your order).
Section 17 - Prohibited Uses & Website Security
In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: (a) for any unlawful or malicious purpose; (b) to violate any applicable regulations or laws; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, or harm any other person; (e) to transmit false or misleading information; (f) to send spam or unsolicited promotional material; (g) to impersonate any person or entity; (h) to upload or transmit viruses, trojans, worms, or any other malicious code; (i) to reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services; (j) to collect or track the personal information of other users; (k) to use any robot, spider, scraping tool, or automated means (including AI tools) to access the Services without our permission; or (l) to crawl or scrape data from, or attack, our website (including via a denial-of-service attack).
By breaching this provision regarding malicious code or unauthorised access, you may commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and disclose your identity to them. In the event of such a breach, your right to use our Services will cease immediately, and we reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine you have violated any part of these Terms.
Section 18 - Automated Agents (AI & Bots)
This section applies if you use, enable, or cause the deployment of an "Agent" — any software or service that takes autonomous or semi-autonomous action on your behalf to access, use, or interact with our Services (for example, AI shopping assistants or automated bots).
No Agent may access, use, or interact with our Services unless it, at all times: (i) clearly identifies itself as an Agent in any request made to our site, including within the request's user agent string; (ii) does not conceal or disguise that it is an Agent, including by mimicking human behaviour or bypassing measures (such as CAPTCHAs) intended to distinguish humans from computers; (iii) responds truthfully to any prompt seeking to establish whether an interaction is from a human or a computer; and (iv) does not circumvent any measure we use to control how Agents interact with our Services.
We may limit, restrict, or block Agent access to our Services at any time, using technical or other measures, at our sole discretion.
Section 19 - Limitation of Liability & Disclaimers
We do not guarantee, represent, or warrant that your use of the Services will be uninterrupted, timely, secure, or error-free, and any reliance you place on information available through the Services is at your own risk. The Services, and all products supplied through them, are provided 'as is' and 'as available', without any representation, warranty, or condition of any kind, either express or implied, including implied conditions of satisfactory quality, fitness for a particular purpose, or non-infringement, except where such conditions cannot lawfully be excluded.
In no case shall SALMA MYA, our directors, officers, employees, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind—including, without limitation, lost profits, lost revenue, lost savings, loss of data, or replacement costs—arising from your use of the Services or any products procured through them. Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, for fraud, or for any other liability which cannot be excluded or limited under English law.
Section 20 - Indemnification
You agree to indemnify and hold harmless SALMA MYA, our affiliates, officers, directors, employees, and agents from any losses, damages, liabilities, or claims (including reasonable legal fees) arising out of: (i) your breach of these Terms; (ii) your violation of any law or the rights of a third party; or (iii) your access to or use of the Services.
We will notify you of any claim covered by this section, and we may control its defence and settlement at your expense, though we will not settle any claim requiring a non-monetary obligation from you without your consent (not to be unreasonably withheld). You agree to cooperate with us in defending any such claim.
Section 21 - Termination
We may terminate this agreement, or your access to the Services, at our sole discretion and at any time, without notice, and you will remain liable for all amounts due up to the date of termination.
The following sections survive termination: Intellectual Property Rights, Feedback, Limitation of Liability & Disclaimers, Indemnification, Severability, Waiver & Entire Agreement, Governing Law, and any other provisions which by their nature should reasonably continue beyond termination.
Section 22 - Severability, Waiver, Entire Agreement & Assignment
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall nonetheless be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms, without affecting the validity of the remaining provisions.
No delay or failure by us to exercise any right or remedy under these Terms shall operate as a waiver of that right.
These Terms of Service, together with any policies referenced within them, constitute the entire agreement between you and us, superseding any prior or contemporaneous agreements, communications, or proposals, whether oral or written.
You may not transfer or assign this agreement, or any of your rights or obligations under it, without our prior written consent, and any attempt to do so will be void. We may transfer, assign, or delegate these Terms and our rights and obligations under them at any time, without notice to you.
Section 23 - Governing Law and Jurisdiction
These Terms of Service, and any separate agreements whereby we provide you with Services, shall be governed by and construed in accordance with English law. In the event of any dispute arising in connection with these Terms, you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
Section 24 - Changes to These Terms of Service
You can review the most current version of these Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of, or access to, the Services following the posting of any changes constitutes your acceptance of those changes.
